1. Acceptance of Terms

By downloading, installing, accessing, or using MettaTrackAI™ (the "App") or visiting MettaTrackAI.com (the "Website"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the App or Website.

These Terms constitute a legally binding agreement between you and MettaTrack LLC ("Company," "we," "us," or "our").

MettaTrackAI is a mobile health tracking application that provides:

The App is intended for personal health tracking purposes only. It is not a medical device and has not been approved, cleared, or authorized by the U.S. Food and Drug Administration (FDA) or any other regulatory agency for diagnostic or therapeutic use.

MettaTrackAI is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

The App is designed as a tracking and organizational tool to help you manage and visualize your health data. It is meant to support — not replace — the care of a licensed healthcare professional.

The Company is not responsible for any health outcome arising from use or misuse of data provided by MettaTrackAI.

4. Account Terms

4.1 Account Creation

You may use the App without an account for local-only tracking. A free account is required to enable cloud backup and sync features. You must be 13 years of age or older to create an account.

4.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately of any unauthorized access to your account. The Company is not liable for losses resulting from unauthorized account access due to your failure to safeguard your credentials.

4.3 Account Accuracy

You agree to provide accurate, current, and complete information when creating your account and to update it as necessary.

5. Subscription & Billing

5.1 Free Tier

A free tier is available with limited features as described on our Pricing page. The free tier is available indefinitely without a credit card.

5.2 Pro Subscription

Pro subscriptions are available on a monthly ($6.99/month) or annual ($59/year) basis. Pro features include AI food parsing, CGM integration, medical PDF reports, cloud backup, and full device integration.

5.3 Beta Access

During our beta period, Pro features may be offered at no charge. Beta access does not guarantee continued free access after the beta period ends. We will provide at least 14 days' notice before transitioning beta users to paid plans.

5.4 Billing & Payment

Subscriptions are billed through the Apple App Store or Google Play Store. All billing is handled by Apple or Google — we do not store your payment information. By subscribing, you authorize the applicable platform to charge your payment method on a recurring basis.

5.5 Cancellation

You may cancel your subscription at any time through your App Store or Google Play account settings. Upon cancellation, you retain Pro access until the end of your current billing period. No partial refunds are provided for unused time within a billing period.

5.6 Refunds

Refund requests must be made through Apple App Store or Google Play Store according to their respective refund policies. We do not process refunds directly. In exceptional circumstances, contact us at support@mettatrackai.com and we will work with you.

5.7 Price Changes

We may change subscription pricing with at least 30 days' advance notice. Price changes will not affect your current subscription period — changes take effect at your next renewal.

MettaTrackAI™ and the MettaTrackAI logo are trademarks of MettaTrack LLC. All rights reserved. The App, its content, features, and functionality are owned by MettaTrack LLC and are protected by U.S. and international copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

Your health data remains yours. We do not claim ownership over data you enter or import into the App.

10. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, METTATRACKAI IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses. We do not warrant the accuracy of any nutritional information, glucose readings, or health data displayed in the App.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, METTATRACKAI, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR PERSONAL INJURY, HEALTH OUTCOMES, LOSS OF DATA, OR LOSS OF PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP OR THESE TERMS.

In no event shall our total liability to you exceed the greater of: (a) the amount you paid for the App in the twelve months preceding the claim, or (b) fifty dollars ($50.00).

Some jurisdictions do not allow the exclusion or limitation of liability for certain damages. In such jurisdictions, our liability shall be limited to the extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless MettaTrack LLC and its affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App.

13. Termination

We may suspend or terminate your account and access to the App at any time, with or without notice, if we determine that you have violated these Terms. Upon termination, you may export your data within 30 days before it is deleted from our servers. We will not be liable for any termination of your access in accordance with these Terms.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which MettaTrack LLC is incorporated, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules.

You and MettaTrackAI agree that any arbitration shall be conducted in your individual capacity only, and not as a class action or other representative proceeding.

We reserve the right to modify these Terms at any time. When we make material changes, we will:
